Welcome to www.waterdoctorsofpittsburgh.com (the “Site”), operated by Ellsworth Pro Solutions, Inc., doing business as Water Doctors of Pittsburgh (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site and any related services we provide.

By accessing or using the Site, requesting a quote, scheduling service, or otherwise interacting with us, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

We provide mobile automotive services in the Pittsburgh, Pennsylvania area and surrounding regions, including but not limited to:

• Interior water leak diagnosis and repair
• Wind noise diagnosis and repair
• Vehicle odor elimination

Services are provided on a mobile basis (we come to your location or a mutually agreed site, subject to access to water when required). Specific pricing, scope of work, and timelines are determined on a case-by-case basis and confirmed before work begins. We may decline service at our sole discretion.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or request services. By using the Site, you represent that you have the legal capacity to enter into these Terms.

You agree to provide accurate, current, and complete information when contacting us or requesting service. You are responsible for maintaining the confidentiality of any account credentials (if applicable) and for all activity under your account.

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to the Site, our systems, or other users’ information
• Interfere with or disrupt the Site or servers
• Transmit viruses, malware, or other harmful code
• Scrape, harvest, or collect information from the Site without our prior written consent
• Misrepresent your identity or affiliation
• Use the Site in any way that could damage our reputation or business

We reserve the right to suspend or terminate access for violations of these Terms.

Payment terms will be communicated at the time of service. We may require payment upon completion of work or according to agreed terms. Late payments may incur reasonable collection costs.

Any warranties or guarantees related to our work will be provided in writing at the time of service (or as otherwise stated). 

The Site and all content on it (including text, graphics, logos, images, and software) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any content without our prior written permission.

“Water Doctors of Pittsburgh,” related logos, and other marks are our trademarks or service marks. You may not use them without our prior written consent.

The Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of those third-party sites. Your use of third-party sites is at your own risk and subject to their terms.

THE SITE AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific results from our services beyond what is expressly stated in writing for a particular job.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ELLSWORTH PRO SOLUTIONS, INC., ITS OWNERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM (OR $100 IF NO PAYMENT WAS MADE).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless Ellsworth Pro Solutions, Inc. and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another party.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If not resolved, exclusive jurisdiction shall lie in the state or federal courts located in Pennsylvania (preferably Washington County or Allegheny County, as applicable). You consent to personal jurisdiction in those courts.

We may update these Terms from time to time. The “Last Updated” date at the top will reflect changes. Your continued use of the Site after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

We may terminate or suspend your access to the Site at any time, with or without cause or notice. Upon termination, the provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnification) will remain in effect.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and us regarding the Site and services, and supersede any prior agreements.

SMS / Text Messaging Terms

By providing your mobile phone number to Ellsworth Pro Solutions, Inc. (d/b/a Water Doctors of Pittsburgh), you consent to receive text messages from us related to your service requests, appointment scheduling and reminders, service updates, quotes, and other transactional communications. Message frequency varies. Message and data rates may apply. You can opt out of receiving text messages at any time by replying STOP. For help, reply HELP or contact us at 412-838-3366. Consent to receive text messages is not a condition of purchasing any goods or services. Your mobile information will not be shared with third parties for their marketing purposes.
